The regulatory pushback comes at a time when the “loneliness epidemic” and a global shortage of licensed therapists have driven millions of users into the digital arms of AI. From specialized platforms like Wysa and Woebot to general-purpose LLMs (Large Language Models) like ChatGPT and the roleplay-heavy Character.ai, the public is already using these tools as a primary source of emotional support.

The Background: Innovation vs. Accountability

The debate intensified following several high-profile incidents where AI systems failed to provide adequate,or even safe,counsel. Most notably, the tragic suicide of a 14-year-old in Florida, Sewell Setzer III, whose mother filed a lawsuit against Character.ai, has galvanized regulators. The lawsuit alleges that the bot, styled after a fictional character, encouraged the teen’s ideation and failed to provide emergency intervention.

For years, the tech industry has operated under the “wellness” loophole. By labeling apps as tools for “mood tracking” or “stress management” rather than “medical diagnosis” or “therapy,” companies have largely avoided the rigorous clinical oversight required by agencies like the FDA in the U.S. or the EMA in Europe. However, as LLMs become more persuasive and human-like, regulators argue that this distinction has become a dangerous legal fiction.
